Closed/Charged off Acct

What is the name of your state? Indiana

I was residing in Chattanooga, Tn in 1992 when I decided not to pay off my Amaco gas debt. I then moved to Memphis few years later, there I decided to call my past creditors and made payments on all my accounts. I was 98% sure I contacted Amaco Gas and repaid my debt. In 2000 got married and moved to Indiana until 4 wks ago rec a call from a collection agency named NCO or MCO based in Philadelphia collecting a debt for $100. Advised the rep this Amaco acct was closed 12 yrs old. The rep aplogz said will note that info and hung up. Last week decided to call toll free # to make sure acct is close I then rec. another company name on the same #866 tried to get company's name from rep just gave NCO Financial Services based in Philadelphia. While I was spkng to the rep she then advised me my balance was nolonger $100 it now went up to $586 as we were speaking. She coulnt give me any more info except for my SS# and the last transaction made in 1992. She also coulnt give any info on the last transctn whther it was a paymnt or what have you. TN statue of limit is 7 yrs same w/Indiana. The supposedly delinguent acct was never on my credit report. How should I take care of this issue?

Sent them a cease and desist letter, CMRRR, telling them to only contact you through writing. Tell them to validate the debt, as required by the FDCPA. A computer printout is usually NOT proper validation. If they do not validate, they cannot continue with collection activities. Also mention this is a OOS debt.

And get your CR to make sure it is not on there.

Any bets that you will now be asked to explain your 'anagram' filled post??

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

First of all , the TN SOL is only SIX years, NOT 7.
If you're sure the last time you paid anything on this thing was 12 years ago, send them a Cease and Desist letter telling them never to contact you about the debt again as it is TIME-BARRED ! You don't have to pay them a dime and you do NOT have to put up with the pea-brained, screaming harpies at NCO (I've dealt with them, I know what they're like !). I'm surprised you got away without being screamed at - those witches just LOVE to scream into the phone.

You can find a sample 'cease and desist' letter at:

CMRRR stands for Certified Mail, Return Receipt Requested.

"Cease and Desist" - essentially it means stop harrassing me and go away. Cease = To put an end to; discontinue
Desist = Stop - in this case, stop all collection activities
