| i became co-signer of a person who lives in portland oregon who filed bankruptcy. of course the company came after me to pay the debt. i do have a seperate agreement we signed when I agreed to co-signed, my question is: can I go and sue her for breech of contract and sue her for the money I had to pay? it was over $4000.00. |

Reply to I Am Always Liableyou asked for the contents of the agreement between me and the party I co-signed for. this was for a credit card and I asked her to sign a seperate and brief agreement to be responsible for all the debts that she accrued on the card. i never did get anything from the bankruptcy. I only found out through the credit card company that she filed bankruptcy. The contents are: I ____________, accept all responsibilities for all charges incurred by me on the ________ visa account # _______. unless otherwise agreed upon by both (me) and (her) the outstanding balance on this account will be paid in full each month. Okay, thanks. It's a little on the vague side, but it should still be enough to pass muster in front of a judge. Go get her ! File your action A.S.A.P. and, when you get to court, make sure you bring the Card, and all Statements. It would also be advisable that you call the Credit Card company, ask for, and pay for, copies of all of the Charge Slips that she signed. That evidence will be irrefutable and invaluable to your case. IAAL |
