Collecting a debt


What is the name of your state?
I currently live in California. Written agreement was signed while living in Oklahoma.

I loaned a friend $6000+ and had them sign an agreement stating they would pay the money back. They have since moved to Florida and I have since moved to California. I have made several attempts (5 certified letters and an email) to contact this person in order to collect the debt to no avail. This loan was given in 2001 while both parties lived in Oklahoma.

What are my options to collect the debt at this point? Can I sue for collection of the loan? If so, what state do I file the suit in? Since I am in CA now can I file out here? Would hiring a collection agency help? Can you hire a collection agency for personal debts? Lots of questions I know…

Any answers or advice is appreciated.

Yes, you could hire a collection agency to collect for you but they'll take quite a bite out of what you get back.

Sue them, but you'll have to sue them in FL in order for it to do any good or for you to have any hope of recovering your money.

Wow! Thanks for the quick response Ladynred - I appreciate it. I have a couple of follow-up questions. If I sue them in FL, will I need to travel to FL for any reason? Will I need to hire an atty. in FL? Is there any way to file from here in CA?

If I hire a collection agency, can I hire a CA one?

Not if you hire a lawyer in FL to represent you. CA's do this all the time.

Sure, get the forms for small claims court needed for FL and file them per the instructions/state laws.
