Question

Collecting on debt over 4 yrs old


What is the name of your state? MI

I have a small business providing services to individuals. Some of these individuals still owe me for services rendered over four years ago. I have sent them request for payment letters a few times.

If I send a demand for payment letter now, am I violating any collection laws?

An orginal creditor is not bound by the FDCPA. Collect away!

If they are that old your chances of collecting are the same as the proverbial snowball. You also need to check the statute of limitations. Your best bet is to file in small claims. The local magistrate can provide the forms and give you the small claim dollar limit.

Assuming you win all you will have is a judgement which you then have to try to collect on your own. The courts do not do this for you.
