collection


I settled a collection on a revolving account. The retailer has hired another collection agency to collect on the same debt again. I thought that once a collection has been settled, it was done. Can they come back a second time for the same debt after it has been settled through a collection agency?

Did you settle for the entire amount of the debt or just a portion ?
It is legal in many states for a creditor to send to another collection agency specifically for the purpose of getting the remainder of the balance owed if you didn't pay it all !

The original account was in Oregon. The collection company found me in California. I settled with the collection agency with the understanding that it was a final settle, debt paid in full. So can they misrepresent the settlement? I am now residing in Oregon again.

Ouch! Not good.

About all I can suggest is you execrise your rights under the FDCPA and demand they validate the debt and, hope they can't.
