What is the name of your state? new york

back in 1999 i went thru andrew capoccia for a debt reduction. i met my part of the agreement by making all payments for 32 months,in which i was told my debt would be done, but it isn't. im now getting letters from a credit card lawyer saying i have to pay $5000.00. i also got a certified letter from the lawyer saying i have 7 days to fill out this form about how much i make how much my home is worth,my car and about my bank acount. the lettler says information subpoena and supreme court of new york but dosen't have any signature of a judge. do i have to fill out this paper and is there any thing i can do about capoccia not fullfilling their agreement? we have heard that capoccia has been sued in ny and vermont regarding his debt reduction clients.

Take those documents and consult with an attorney, then file a complaint against that company with the Better Business Bureau of NY

First, YES you have to fill out that information subpoena and return it in the time given. If you ignore it, they CAN issue a warrant for your arrest. This lawyer is looking to find out what your financial situation is in preparation for a lawsuit to get a judgment ! Your wages can be garnished, non-exempt property siezed, and liens placed on your property.

Every state has exemptions from judgments for personal property. You need to find out what they are in NY and be prepared to file your exemptions so that they don't try to sieze property that would otherwise be exempt !

Second, do you have the contract from the service you used ? What are the terms. If he breached the contract, you probably have grounds to sue him yourself. Was this account included in the plan you were paying this guy to pay your debts with ? Did the creditor agree to participate in it ??
