a credit card collector phoned tonight requesting a payment of which I can not pay. i told her that, but she kept pounding on me and told me she would call both my employer and my husband's employer. my husband is not even a card holder. i requested she not call our work and she rudely told me she was going to anyway. we live in texas. how should i handle this?

Don't get upset this one is easy.


First you need to write to them telling them they must cease and desiste all calling including work. Only in writtig shall they contact you.

You must send this certified return receipt so if they call you after it is signed you can sue them in small claims court.

I hope you have the letters they sent to you so you have the mailing address and the account number. What ever you do.. don't ask them for it.. they will never give it to you....!! Just wait for it to come in the mail and write to them. ALSO YOU MUST make copies of this and store it some place you can have for back up ....!!! You will also need to keep a pen and paper by the and write down the name, time and date of when they called. Even if you don't anwer and they leave a message write it down...!!

Your letter should look like this...

Company name
add..
XXX

RE: CEASE and Desist only respon in writing/ account #

Dear Sir

You are heare by notified that you service by telephon are no longer desire. Only in writing shall you contact me abou the account>>>>>>>>> . This isin accordance with the laws of the FDCPA.

If you fail to comply after date on the signature of return receipt. I will be forced to contact my States Attorneys Gerneral's office and the Federal Trade Commision and sue you company civily and criminally.

Don't forget to date it and sign it. MAKE COPIES....!!!! You will have to revise this a bit....it's late....LOL...!!

They always call and it is the easier 1500 dollars you will ever make. They never show up in court......LOL.....!!!!!
