A Collection Dis-Connection?What is the name of your state? MD A collection agency located in TX has been calling my home leaving very menacing messages over the past few days. When I asked them for information regarding what this debt was for, they refused to give me any information, and told me that all I needed to know was that I owed them $750. I suspect that this is not legitimate because I have not received anything from this company in the mail. They won't give me their mailing address (although I did find it by googling their phone number on the internet), and keep insisting that I need to set up an automatic payment from my checking account, or make a payment by Western Union. I don't know what the original debt was, when this debt was supposedly incurred, or anything. They flat-out refuse to tell me anything other than I need to pay them $750 ASAP. All I know is that they are a registered collection agency in my state. Isn't a collection agency supposed to notify you in writing before they refer the case to court? How can they take me to court if they won't tell me who the original creditor is? What are my rights in a situation like this? :confused |

| "Isn't a collection agency supposed to notify you in writing before they refer the case to court?" *** There is no statutory obligation for a valid creditor to notify you prior to a lawsuit. However, unless this CA has purchased the debt (unlikely based on your description of them), they probably can't bring a lawsuit anyway. "How can they take me to court if they won't tell me who the original creditor is?" *** Several ways. One being, if they are the debt owner, they can file a lawsuit. "What are my rights in a situation like this?" *** Since you have 'googled' them and now have their address, send them a letter (certified RRR) DEMANDING that they validate the debt. A good sample letter (with questionaire) is at: http://www.creditinfocenter.com/forms/
__________________ There are at least 17 lawsuits (!!) pending in various courts, including the US Supreme Court, asking if Obama is a natural born citizen (as req'd by Art II, Sec 1 of the US Constitution). Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport! |
