| Michigan- How do I stop collectors from calling me night and day! They keep caling me and treating me.I have asked them to stop and send mail but it dont work |

STOPPING DEBT COLLECTOR HARASSMENTSounds like these debt collectors are violating portions of the federal Fair Debt Collection Practices Act (FDCPA) section 805; also known as Title 15 U.S. Code section 1692. Look up the statutes for yourself at [url]http://www.ftc.gov[/url] or [url]http://www.findlaw.com.[/url] A couple of questions though. Are these collection agencies or attorneys harassing you or are the original creditors; that is the people you actually owe the money to? The federal statutes do not apply to original or first party creditors; only to those who are hired to collect the debt for them. Also did you send the "drop dead" letter via certified mail return receipt requested? If not, do it now. Thirdly, how well are you documenting the phone calls? If you have CALLER ID, keep the phone numbers that are recorded in the memory. Recording the phone calls is good with a phone coupler and/or answering machine; however to be legal, you must first ask the caller's permission to record their converstaion. That may end their calls right there. Finally, find the right attorney; one who specializes in debt collection case in Michigan.
