College Credit Card Debt


What is the name of your state? Michigan
My son had a college credit card with $500 on it. When he graduated, he could not pay it. We made payments on it for a time - not always timely though. We paid over $2000 and had it down to about $800 before giving up around 1999. He is unemployed and has a medical condition. He has no money and no property. The debt occurred in Pennsylvania and that bank sold the debt to another company. Now the last company has sent a certified letter to my address for him. I did not accept it and have told them on the phone that he does not live here. He has no resources. Where should we go from here?

The card was issued when he lived in Pennsylvania and he is now being served in Michigan. Does this make a difference? When does the SOL start and end?

IF your son is being sued, that *could* be the certified letter and it is a BAD idea to ignore it. Avoiding it will NOT prevent them from getting a judgment.

Better to get his day in court than to just let them win by default. It is very likely he would have the opportunity to settle for much less prior to going in front of a judge.

The SOL in Pa is 4 years on an open account which is what a credit card is considered. Go to court and use it as a defense. They can not collect on a debt that is over the limit.

The debt may have occurred in PA, but unless the son LIVES there, and is being sued there, the PA SOL does not apply. The writer' state is Michigan- SOL=6 years.
