College Credit Card Debt Revisited


What is the name of your state? Michigan
I just want to be sure I understand the particulars of this.
My son got the card about 7 years ago when he lived in Pennsylvania, then moved several times before coming back to Michigan. He does not live with me and has not for more than 9 years.
Today a notice was taped to my door indicating he is being sued for this debt.
From the replies posted, I gather that he can be sued in Michigan for this debt and that the Michigan SOL applies - 6 years from the last payment.
Has he been legally served since he does not live with me? What should I do with the notice?
He has no property or goods. He is not employeed, is receiving medical treatment and may be placed on SS disability. Should he ignore the summons, what would happen? Were he to go to court, what would happen?

If they only have your address as his last known address, then yes, the service is legal.

He should NOT blow off court, he should answer the summons (if required) and go to court. He may be able to settle. He's pretty much judgment proof right now, and they can't touch disability money. He should at least present his side in court.

The last address they have is the address he lived at in Pennsylvania - his college address. Of course, that address would have returned all mail for him. They have my address as his "home address" for college.
