Question

Complicated Question?

What is the name of your state? Louisiana

Hi there! My apologies for not being so brief here:

About a year and a half ago, I was with a company, "BCR". I had a company credit card, which I never used. My name was on the card, as was the name of the company.

When I resigned, I cut my card in half and gave it to the company.

Three months ago, apparently, they stopped paying their company credit card account.

The credit card company is calling me, and says I'm responsible for their charges. I've submitted in writing that I'm no longer with BCR, and never authorized any charges on the card, and they should probably contact the company, which has been paying on the account for the last year or more.

At least 4 times now, they've called me, and every time I've explained, and usually the person on the phone seems understanding of the issues, and agreed that this was a company card. I have, of course, asked them to stop calling me, and to take the name of my card.

The last person was rather rude, and insisted that I was indeed responsible. They've even reported me to a credit agency, and I was denied a card on the basis of this "default".

I've asked them to provide proof that I authorized charges, which, naturally, they have not done. They wish me to write another letter asking for such proof, but I see no reason to continue wasting time like this.

Seriously, can I be held personally responsible for unauthorized charges on a card I do not have for a company account which I'm not associated with?

Is there a simple way I can clear this up? I'm at the point now that I'm considering charging the credit card company for wasting my time with these repeated calls.

Thanks greatly,

Rick

Is this an AmEx card??? If so, then you are personally liable for the debt (read your application).

You say that your name was on the card which typically means that you have some liability. Ask the card issuer to provide a document that shows your liability.... AND your signature.
This 'right' is provided in the FCBA (Fair Credit Billing Act).

Also, your 'right' to accurate credit reporting (to attempt to clear the credit report 'hit') is provided in the FCRA (Fair Credit Reporting Act).

There are at least 17 lawsuits (!!) pending in various courts, including the US Supreme Court, asking if Obama is a natural born citizen (as req'd by Art II, Sec 1 of the US Constitution).

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

Nope, not an Amex Card. I think it's Visa, from First USA.

I never received any bills for the card, since the billing address was for the business, and it has been a long while...but I definitely know it's not Amex.

Guess I'll fire off one more letter, following the precise template and such advised from that website, sure seems like I did it that way last time (although I didn't get the confirmation notice).

Thanks.
