contacted by credit bureau, old hospital bill


What is the name of your state? What is the name of your state? georgia

i was put in the hospital in 1995, i had no job or insurance, and i was never contacted or sent any bills for that, well, a week ago i got a letter in the mail from credit bureau saying that i owed 2800.00, i called them and they were able to verify that bill was made back in 1995 and that the hospital turned me over to them, well, theres no way i can pay that, is there anything they can do to me, like get a judgement against me if i refuse to pay??

Only $2800? Oh dear. I have over $400,000, yes, four HUNDRED thousand, not forty, not four, but four hundred thousand dollars) in medical bills and am still not back in work. Hospitals sure take their sweet timne contacting you, don't they? I'm personally filing bankruptcy. If you can't pay and aren't so worried about credit, such as if you are in a stable home, then you may want to consider that yourself, and either list all your bills, or salvage your credit and just file for the medical bills. Oh, they may try to take you to court, they may not. Worst case scenario is they win and you still have the bill. You're right back where you are right now. I do not believe hospitals write off bills, so you'll either need to pay or file bankruptcy on that bill. It looks better on your credit report to just file for the one bill, but if you file for all, then you'll have more money to try starting clean. But to file for ALL of them, you have to show you can't pay, like me. State disability does not pay much to a 21-year-old who was hit by a car while crossing a street at 19, especially when she has been unable to work since 19. Get the book on bankruptcy by NOLO Press, the publisher most recommended by lawyers, and read up. If yo decide to file, all the forms are IN the book! Go to [url]http://www.nolo.com[/url] for more info or to your local Barnes & Noble or Borders or Amazon.com for it. It'll provide lots of info. Don't worry, you won't go to jail. I'm more likely to go to jail over the $400,000 and even I won't.

My response:

Don't panic. Bankruptcy is unnecessary, and you don't have to pay the debt. That's right, and MSWCCC is wrong - - and I'll tell you why . . .

Georgia's Statute of Limitations on debts incurred as the result of a signed contract (your hospital intake papers) is six (6) years. It has now been seven years, and they can't collect.

So, tell them not to bother you any longer because the Statute of Limitations has expired. However, if they should sue you, you must still "answer" the Summons and Complaint by pleading the Statute of Limitations as your "affirmative defense" - - then, the lawsuit will be dismissed - - forever.
