I am stationed in south carolina.I cosigned on an auto loan for my mother who was financialy stable 6 mos ago. I recently found out that she is now broke and has been evicted and has retuned checks totalling 3000.00. The loan was past due for 3 mos and she let the insurance go. Both our names are on the title and I want to get her name off since I am now paying for the vehicle. I went and took the vehicle(had it towed) 1 day before the finance company came to get it. I have insured it and paid up the loan to currant. My mom is financing my brothers shaky habits and chooses not to stop. She thinks she can save him. In the meantime what can I do? Please,please help me!

I don't mean to sound unsympathetic, but help you do what ?

Deal with the car ? The insurance ? Your relationship with your mother ? Your mother's dealings with your brother ? The whole "ball of wax" ? What ?

The question is how do I refinance this loan without her adn how can i get her name off?

My response:

Then, the presumption is that you've asked her to sign the title papers, and she refuses to do so. She's aware of what she did, aware that the car is gone, aware that you are now making the payments, aware that she probably ruined her credit rating along with yours, and she still won't sign the title papers.

Then, your only recourse is to sue her for "partition" - - that is, to have a court order her to sign the title papers so that you can refinance the loan into your name, alone.
