CRA is going to get sued!! How do I begin?


What is the name of your state?What is the name of your state? Washington state

I have been educating myself on credit repair. The last 5 months I have been disputing all negative information on my credit file and my husbands. Some is mine, some is not.

I have only been dealing with the 3 big ones, Equifax, Trans Union, and Experian. I have gotten several items removed because they could not verify that they were ours. But, others aren't being investigated at all.

-failure to provide procedures of investigation ( in 15 days or correctly)
-failure to maintain reasonable procedures to ensure accuracy
-failure to mark accts. in dispute.
-failure to reinvestigate a trade line

Those are just a few violations I can come up with right now.

I really want to stand up for my rights as a consumer!

How do I begin the process of filing suit for these violations???

Do I need to cite the FDCA laws that have been violated??
If I go to my local county court, will they help me with filing this? Will they know what I need to do??


I have wrote some stronly worded letters to these agencies and some have done as I have asked, but others just ignore me!

I am not playing games with them and want to move forward.

A: Hire a debtor-creditor lawyer.

A: No. Courts will not give you legal advice; you need a lawyer to give you legal advice.

Also, you will have to sue in a state superior court. If you were to sue in a county district court the CRA will ask for and recieve a change of court. Do hire a lawyer, you will not win a court case against the CRA's on your own.

Fair Credit Reporting Act


I got the same runaround from the credit reporting agency I was dealing with. Go to [url]http://www.ftc.gov/os/statutes/fcra.htm[/url] You can download a copy of the Ferderal Rules that credit reporting agencies have to follow. Section 611, Procedure in Case of Disputed Accuracy, Section 609 titled Disclosers to Consumers and section 616 Civil Liability for Willful Noncompliance may give you some information to help. Read it carefully, cite the sections & quote to them, then send it certified mail ( returm reciept requested). They seem to change their tune in a hurry!!!!!
