credit card chase


What is the name of your state? AZ

I have a credit card in my name, but the charges on it have been incurred by my ex-husband (the divorce is not finalized).
I have a restarining order against him so I can't contact him, and the authorities also do not know where he is (he has a warrant).
I took him off the account as soon as I found out he was using it. I have statements that show he was living in WI/IL and I was living in AZ at the time the charges were made. It also states in the divorce papers that he is responsible for any debts that he has incurred since the separation. The credit card company is coming after me despite the situation, and they are threatening to take me to small claims court for the money. What are my legal rights, please?

The card was in both names during this time, so your stbx had every right to use the card (as far as the CC Company is concerned). The CCC is going to go after whomever they are able to locate and have nothing to do with what the judge has ordered for your separation/divorce. You would need to take that part of it back to court and show that he is not complying with a court order.
