credit card collectionWhat is the name of your state? massachusetts after not being able to pay on our providian credit card for a while, they turned it over to a collection agency. we have now been making payments to the collection agency for almost a year. the payments were 3% of the balance. we have now sent all our credit cards to a consumer credit counseling service. they also pay 3% of todays balance. the collection agency for providian says they will not accept this lower payment. they said they will take my husband to court and attach his wages. he is the only name on the card and the only wage earner. they could not do this if we lived in florida but i do not know what the law is here in massachusetts. |

| Yes, they can garnish your husbands wages in MA. 75% of his net pay would be exempt, they get the rest ![]() You made a deal with the devil when you started paying the collection agency. There's NOTHING that says any creditor has to participate in a debt counseling program. Unless he wants to be sued, you're stuck paying at the same rate you have been. Providian is nasty, they WILL sue.
