credit card company issue


What is the name of your state? FL
a relative has a problem that I'm hoping someone can help with, having a problem with a credit card company. they say they never got a check a long time ago and they did and cashed it. she told them 'i have proof of the cashed check' meanwhile they charged a late fee. said she wasn't paying that fee and with that late fee put her over the limit and charged her another fee. every month from then out charged her fees. couldn't pay it all at once. they tried to get her to settle a price but said she had to pay it within like 2 weeks or something stupid. she said 'i can't do that!' now they are threatening to have her arrested and sue her etc etc. what are the laws regarding this. does anyone know? can they make threats like this? i would they would send her out letters to prosecute yes but the threats of having her arrested and such are absurd i think. but as you can see by my username.... so that's why i'm here hoping someone can help her.

they can not have her arrested. did she ever send them a copy of the proof she has that they received and cashed the check? was the check originally sent and received on time?

Every credit card has policies in place for disputing bills. You relative should have followed those procedures and maintained the payments while the process was in progress.
