Credit Card Fraud??


What is the name of your state? VIRGINIA

I'M IN THE MIDDLE OF AN UGLY DIVORCE AND CUSTODY DISPUTE WITH MY EX. I USED A CREDIT CARD OBTAINED WHILE WE WERE MARRIED TO PURCHASE FURNITURE UPON SEPARATING FROM HIM. THE CARD WAS JUST IN HIS NAME ALTHOUGH MY INCOME AND INFORMATION WAS USED TO OBTAIN THE CREDIT. MY INTENT WAS TO PAY IT OFF PROMPTLY BUT HE FOUND OUT ABOUT IT BEFORE I COULD PAY IT OFF. WE AGREED TO HAVE THE AMOUNT PAID IN FULL WITHIN ONE WEEK. IT WAS DONE. HE DOESN'T LIKE THE MAN THAT I AM DATING, HE INTENDS TO FILE FELONY CHARGES AND HAVE MY HEALTHCARE LICENSURE REVOKED, EVEN THOUGH THE ISSUE HAD BEEN SETTLED? WHAT CAN HE DO? CAN HE HAVE MY LICENSE REVOKED?

Thanks for the email etiquette, my house. Didn't realize the all caps thing. Was that a no on taking the license, or that he can file charges? No to both? Debt Collector. I don't have any docs, the ex has them...including that the account was settled. Thanks for the quick reply. Anyone else out there have any experience with this kinda thing? He has quoted a statute of limitations, etc. He is trying to use the fear factor to get what he wants, me to roll over on every issue that is being debated in the divorce, including custody.

I forgot to add in the post that he is also trying to claim identity theft. I didn't assume his identity, I just used a card that we obtained together while married, but in his name only, according to the card issuer. Can he do this? I am in VA

In VA--I had to fill out my income info on the app as if I was co-app. but not an authorized user on the card. The balance was paid in full per a verbal agreement that we had made within a week. Can he still file charges even though the debt was paid?

You probably shouldn't have used the card. But I *think* the most he could do is sue you to get back the money you charged, but since you already paid it, then he can't do that. He can't get your license taken away, only the regulating board can do that. He can file a complaint with them, but since it has nothing to do with your job, they might not even read it. He can't file criminal charges, all he can do is inform the police/DA and THEY make the decision on whether to file charges (also seems doubtful since you did pay off the amount charged). I don't know enough about identity theft to answer that one, but it doesn't SEEM to qualify. The only strange thing is that YOU filled out the application for a card in HIS name. Did he also fill it out? Did he sign it? Did you sign it?

He also filled out the app. We included both of our income--I don't exactly know why the card was only issued in his name. I don't recall the conversation that led to that decision. I don't recall who signed what. I would assume that we both signed the app.

Ex to be is still holding the credit card that I used, without his permission, over my head to get me to bend to whatever his whim is this week!! Anyone know if he can still pursue this charge if the debt has been settled?

The money is repaid and the police have better things to worry about than silly divorce squabbles.

However, you should pull a copy of your credit report at [url]www.annualcreditreport.com[/url], the really free site for credit reports. If you filled out an application and signed it, then they credit card may be in both your names even though only one physical card was issued. If you are really responsible for this card, then you need to get it cancelled as part of the divorce or else you will be held liable for charges he makes after the divorce is final.

If you did this while you were still married it ain't going no where on a criminal charge if you were married. Except in very limitted issues, everything in a marriage is joint here.
