In 1998 I married, we never lived together because my Mother was ill and I needed to stay and take care of her. So we lived 93 miles apart and were only together on the weekends. Mom died in Aug.2000. By accident I discovered a credit report on me at my husbands home. It had many cards in my name that I did not apply for. I snooped around and found a rubber stamp with my signature on it. I ask my husband about it and he said he needed the money and would pay them off and for me not to worrie. There was also a high intrest loan for around $9000. in my name. I also found evidence of cheating. I have filed for a divorce but my lawyer said if he didn't pay then I am responsible. How can I be when I didn't sign anything? Don't I have rights? He says he will pay but if now how can I protect myself? How do I protect my bank account which is in my name only from being garnished? Please help me!!

Well, your lawyer is trying to give you a dose of reality. Credit card companies do not care who pays, as long as SOMEONE pays. Which means, in their eyes, your name is on the account, so you are responsible.

You need a lawyer to prove you had no opportunity to sign and that this signature was a rubber stamp.

You owe at least half (community debt -- so he owes half) until this is cleared up. Get a new attorney. The cheating thing is not really relevant to this suit.
