credit and collection problemsWhat is the name of your state? Indiana I am currently unemployed and have a few collection companies wanting there money. I just received a summons from Capital One Bank that they are suing me for collection in the county court were I live which is Franklin County. What happens if I ignore this, and do I have to go to court and can I still file bankruptcy and get these people off my back. I live with my girlfriend and don't have any assets in my name. Thanks |

| If you ignore the summons and do not go to court, the will automatically win a default judgment against you. From that judgment, they can garnish your wages, garnish your bank accounts and sieze any non-exempt property you may have. Even though you are currently unemployed, the judgment will sit there for 10 years and the next time you get a job, they'll be there waiting to garnish your check. So.. do NOT ignore the summons. Send in your Answer, you have to agree or deny.. deny something, if you Agree to everything, you're giving them the default judgment. Go to court. You'll probably be offered a settlement or some kind of payment plan. A judgment in your credit report is very bad. Go to court and see if you can make some arrangements to pay them once you get work. Yes.. you can file for bankruptcy.. but do so before the judgment is granted, otherwise it will be more work to get it vacated after discharge.
