Credit Company Claiming I am Coapplicant, No Proof


What is the name of your state? MA

My mother opened a credit card 10 years ago when I was in high school. She was a single parent and listed me as an authorized user for emergency uses and such. I never applied for the card, nor did the company contact me about being a coapplicant. My mother didn't even allow me to have credit cards through college and would have NEVER listed me as a coapplicant. She filed bankruptcy in December. I was listed as an authorized user on two other accounts which have been properly resolved. This particular company, which bought out the initial account, says I am responsible because they have me listed as a coapplicant - which is news to me and is absolutely false! They conveniently don't have the application on file because they discard documents after five years. I've talked to practically every representative possible over the past month and am told different stories each time. Now they are saying that I should sue my mother for fraud, but it was their mistake NOT hers. My good credit (that I've worked hard to maintain) is now ruined and I am supposedly responsible for a credit card that I never applied for. Can you please help me?!?!?!?

Stay off of the phone. Send your disputes through writing, certified mail return receipt. Tell them that until they provide proof that you were a co-applicant, you are not paying for this account.

If they keep trying to get you to pay it, send another letter, certified mail return receipt. State that if they do not remove this account from your credit reports and stop harrassing you within 30 days, you will sue them under state and federal laws.

If they do not comply, sue them in federal court.

If you were a MINOR when your mother opened this credit card, there is NO WAY you could be held liable as a co-applicant !

Make them cough up the proof that you have ANY liability, but if they have a date for when the account was opened, then make sure you outline in big red letters that you were underage when the account was opened !
