Credit debt collection not by original creditorWhat is the name of your state? PA Are there any specific laws in regards to Civil Actions or is it a free for all, anything can be included under the umbrella "Civil Action"? Are there specific laws regarding Credit Card default (is it treated differently because its an "unsecured" debt)? I recently received a Civil Action Hearing Notice for a Collection Company that lists Two banks but not the original creditor, are they able to sue me, is a Hearing the same as a suit? The last activity reported is 12/00 and was to Ameridebt and they sent payment to the original creditor, does this restart the SOL to 12/00? Thanks for any insight, I just want to protect myself from making a stupid mistake.... Jason ![]() |

| There are specific laws, governed by your state. There are all kinds of Civil Actions, judgments are just one of them. In this case the Civil Action sounds like someone is trying to get a judgment against you for unpaid debts. DON"T blow off the court date or they'll win by default. The hearing just means that you and the lawyers for the creditor who's trying to sue you have to appear before a judge so the case can be 'heard'. Take your financial information with you... income and expenses, just in case. You may be given the chance to negotiate and having that information with you would give you some facts to use instead of guesses. If the last payment made on the accounts was 12/00, then, Yes, the SOL was re-set to 12/00.. sorry ![]() |

| Thanks for your response... What if the last payment they received was thru a debt service company, say Ameridebt who then paid the creditor... is that considered an account activity even though I did not send them the payment? |

| They don't care who the payment came from, onlyl that they got one. It doesn't matter, that was the last activity on the account. |
