| Missouri my husband's previous employer issued him a credit card with the company name and he as the user. unfortunately they have not paid the bill for the card. he did not sign a personal guarantee for the card and there was no way he could have received a credit card in his name at the time because of his credit. he was just out of bankruptcy and no one would issue him a credit card, especially a major card company. now he is faced with a collection agency trying to recover the charges. the credit agency has put it on his credit report. we have contacted the previous employer and have sent at least a dozen copies of the expenses but to no avail have we recovered the money. according to the collection agency there are many other individuals, from the same company that have unpaid bills. what recourse do we have? we are trying to get financing for a home and we can not because the debt is very significant. All charges have a receipt to be validated as well as correspondence with several individuals at the company to try to resolve the issue. please advise on the direction that we need to go... Very frustrated. we have been working on this for two years now!!!!!!!!! |

| You should concentrate your efforts on your husband's old company. The credit card company is concerned with the cardholder. They will not redirect their collection efforts. If your husband's name is on the card, that's who they will expect payment from. I understand that your husband was issued a credit card even with bad credit. A company can request that an employee with bad credit be issued a company card based on the premise that if the employee defaults, the company will pay. Usually a company will make that guarantee because if the employee defaults the company can garnish wages if necessary. Since your husband no longer works there, his old company may allow regular collection procedures to commence. It is possible that if there is no repayment for an extended period, the company will eventually pay the debt. But that is only if they issued him the card under the circumstances in which I am presuming.In those circumstances, the company may pay to keep their own credit in good standing for the future. |
