Question

collection agency violations

I have probably listed too much info. thereby diminsihing my chance for a reply, everytime i start relating to what has occured, it gets me going, frustrated and determined to find an answer.

I am battling with a collection agency over charges. Following is a brief summary of my situation.
1. original creditor never informed me of deliquent amount or sent notification that acct was being placed with collections.
2. collection acct. was placed with credit bureaus, before I received notification from collection agency.
3. collection agency is stating I owe for 6 months of service, yet contract states that if paid 3 months in advance [which I did] acct. reverts to month to month at the end of prepaid time.
4. collection agency listes the first day of my deliquency , as the date I entered into my contract and prepaid 3 months.
5. when contacted by credit buearu for validation, collection agency did not refer to original creditor, but verified name and address only, before responding to request.
6. alleged balance listed on credit reports consists of collection agency fee, annual interst [not provided for in contract] and addtional months service rate, that I never received. Can collection agency fee be attached to the alleged amount owed to original creditor on my credit reports?
7. I entered into my contract in June, by October I was turned over to collections and acct. placed with CRA's.
I had made a payment in August, but for some reason it did not clear my bank until March.
8. i have tried BBB, consumer affairs and attorney general office, but each time collection agency responds, that state that the matter has been resolved, which is not the case. So none of these agencies investigated further.
9. I have all the documentation I need to prove my complaint, but I am not sure as to how I proceed or prepare my documents for small claims

I could go on, but what information I would most like advice on is if the charges can legally be applied, these charges are what make up the alleged balance owed on my credit report.
