Creditor Debiting Bank/svngs Account


What is the name of your state? north carolina


I work for an company almost three years ago that terminated me and about two weeks later I received a payroll check in the mail which I thought was fine because I was owed a paycheck anyway. Well a couple of months later I received an letter saying that they over paid me and the check was issued in error and they issued an stop payment and I should not have cashed it and they wanted the funds back. So I called and disputed because if that was the case why did the company banks allow me to cash it and I feel and know I was owed that money. So now after hearing nothing form them in over 2 years I check my account on 5/15 and the companies collection agency has debited my checking and savings account and the bank charged me 75.00 for them to debit my account. My big question is, is that legal on the creditors part and the bank for allowing and charging me to let them go in my account and remove all funds. Please help

No, unless they had gotten a judgment against you, they had no authorization to take any money out of your account. You need to go to the bank and tell them that you were not aware that this was going to happen and you had NOT authorized any type of withdrawl. That would be like me going in and helping myself just because I had your account information. You need to complain ASAP ! Then you need to straighten out whether or not you WERE owed a paycheck.
