Creditor Reports Wrong Chapter BK on Credit Report I am in Illinois. Last year I filed Chapter 7 BK (discharged 11/00). On my petition, I filed four Household Retail Services accounts (K-mart, Best Buy, American Blinds, & Harlem Furniture). On all three credit reports each account is being reported as Discharged in Chapter 13 BK. In the status field, each account states either "Wage Earner or Similar Plan" or "Account involved in Chapter 13 Debt Adj." I never filed a Chapter 13. This needs to be corrected to Discharged in Chapter 7 BK.
These accounts have been disputed with TU, Experian, and Equifax, but they have come back verified and unchanged. I am taking the next logical step and going to Household directly and providing the Schedule of Creditors. I was told that not only is this a violation of FCRA, but also a violation of the BK statutes by Household knowingly reporting incorrect information. They are aware that I filed a Chapter 7 as I ended up reaffirming a China Cabinet on one account and my computer on another. I can find the FCRA violation, but not the BK violation.
What would my next step be if Household does not correct this after my communication with them? |
