Debt Collections Juridiction TX or TN


If a loan is acquired some five plus years ago in the state of Texas through Best Buy, and I am unaware of any collection attempts through Texas Jurisdiction. Sometime later the loan was sold to a collections company. The borrow move to State Of TN and has resided there for 2 years. The collection company has file suit in small claims court under 15,000.00 (3900.00) in the state of TN. Is it necessary for the collection company to first obtain a judgment in TX, and the request the court to transfer this case to TN for collections. However under these conditions does the collections process still follow the originating state laws concerning collections?

Dear Jody,

The collection company is allowed to bring suit in the venue local to the debtor's current residence.

Looks like you may be SOL because the statute of limitations in TN is 6 years.
