New York is not a community property state, so your father-in-law will not be held directly responsible for his late wife's debt. However, her estate will be. Therefore, if she owned a home, a car, bank accounts etc. the creditor will expect to be paid from the proceeds of the estate. If your mother-in-law does not have any assests then her estate is consider insolvent and nothing has to be paid. The creditor would just need a copy of the death certificate.
