| I am the lien holder on a car that I paid for some former friends. They have been behind on every single payment and I finally got tired of it and sent them a certified letter telling them that they had 10 days to pay the balance owed or that they would be responsible for all legal fees, filing fees, attorneys fee, and court costs. Today, by fed ex, I received their December payment in the form of a check. I am sure that if I cash it, I will render the letter null and void. What should I do? Send the money back? Not cash the check? Wait until the 10 day deadline and seek an attorney? How can I legally get the car back? What are my rights?
I signed for the package because I thought it might be the entire payment, but it is just the December payment. Did I already void the terms of the letter I sent by signing for the payment? |
