Question

Dismissed Bankruptcy


i am in ca. my bankruptcy was just dismissed (not discharged) after almost 5 years. i had around $35,000 of students loans from the complete source (company). i have checked, and they are plato loans. i had a cosigner who is now over 80 years old. these were not discharged in my bankruptcy, and are now due i imagine with all the interest accrued. i do not want them to contact the cosigner, and they will not work with me. what can i do? any help would be great. thanks.

Ahhh, you didn't say they were Plato loans before... that makes everything different.

First, if you want to get rid of the debt completely, you can file chapter 7 bankruptcy and the debt will be wiped out completely. However, the bankruptcy would only wipe out YOUR responsibility to repay the loan. Your co-signer would still be on the hook. If they want the debt to go away, they would need to file their own bankruptcy.

Or, if you want to repay without filing bankruptcy, you'll need to set up payment arrangements with the lender. I would start by sending a letter to the lender and offering to make monthly payments.

If the people contacting you and the co-signer work for the original lender, there's nothing you can do to stop them from calling/writing. However, if the loans have been turned over to a collector, you can write to them and ask that they stop calling you (your co-signer would have to send their own letter). If they don't stop, you can possibly sue them for violating Federal law.
