My sister had a surgery 2 years ago while the operation expenses was covered by insurance company. The surgent did not pursue to bill the insurance company eventhough the patient already filled out forms with insurance information upon adminssion. Starting Feb 2001, the surgent hired an attorney to bill my sister for the cost of the operation. She wrote them to explain the cost was covered by insurance company. The attorney office ignored her response, and mailed my sister Summon, and Statement of Service and threaten to sue her. What should she do ? We don't believe we are at fault.

She tried contacting the collector (lawfirm) office to follow up her letter of explaining why she didn't own the money, but all her phone calls were not taken and not returned.

Does she need a lawyer?

Sounds like a lawsuit has been filed. I'd say it's time to see a lawyer.
What I can't understand is why your sister didn't just file the claim herself and assign the benefits to the surgeon? That would be cheaper than paying a lawyer.
