Employer filing Chapter 11 please helpWhat is the name of your state? California I am not sure if I am posting in the right area so please bear with me. I posted this question once already but got no response so I think I posted in the wrong place. If our company Owner declares chapter 11 do the rules change for the employer's obligation to pay employees? What are our rights as employees? Any advice would be great |

| When an employer files CH 11, anything owed to employees in the form of wages is something like 3rd on the priority list of who gets paid.

| Ladynred: Which in turn means that even if it takes years to pay eventually he does have to pay our payroll? Do you know of anything we could do before hand to protect our selves? Thank you for your quick response ![]() |

| I believe you can file a proof of claim with a CH 11 just as you would with Ch 7 or 13. I'd have to check the BK code to be sure though.
