Equifax lost my identity

Yes, for the past 8 years I have been suffering. Equifax is causing me such headache, pain that is beyond anyone imagination simply put; to them I don’t exist. Here is the story.
10 years ago I moved to the US with my family and we were granted SS#s that are very close to each other, to add to this my brother and I have very close first name and this has caused Equifax to mix between him and I constantly over the years. This mix includes his credit items on my credit report, mine on his. However, it got much worse this past year as of now if they type my name or my SS# he comes up and I don’t exist. I could not pull my credit report via Equifax since JAN of 2009. What’s Ironic is that my credit report with Experian and Transunion is spot on and perfect and no problems to be found. "ONLY" Equifax mixes between him and I causing my nothing but loosing loans, higher interest rates and now not existing at all.
I tried to contact them, reason with them sent them all they asked for weeks, months, years nothing got better, nothing got fixed. I get different emails from them with different answer such as

Please be advised that the errors on your credit report may be a result of inaccurate or incomplete
information reported by your current creditors.

List below are some typical reasons:

-The credit application was submitted under different names
-Clerical errors
-The Social Security number was misread or entered incorrectly
-Loan or credit card payments may have been inadvertently applied to the wrong account
-The suffix may have been omitted on the application, such as a father and son with the same name
but different suffix.


This is not the case because Transunion and Experian have the right credit report for me and since I live on the east coast Equifax is what’s used to check on credit reports more than the other 2 agencies.
I am going to sue Equifax this Monday with Fair Credit report act. However, I am not sure how much to sue them for. Honestly the damage they have done is beyond repair in 8 years no joke. However, I would like to be compensated for loosing my identity and my life and spending minimum of 4 hours a day for the past month search, reading, calling regarding this matter.

Please help with Advice.

This is a question for your LAWYER.

Hint: If you don't have one, then drop it now because you don't have a prayer.

Lawsuits are not about justice. They are about MONEY. If you don't want money, then you shouldn't be thinking about suing. And people post here because they are thinking about suing. Because they want money, no matter how much they don't want to admit that to themselves.

Your answer is not helpful tell me something I don’t know. Lawyers will want a lot of money for a case like this and I talked to few already. Even if we win the case their are no guarantees that Equifax wont make the mistake again. My money would go to waste.

I thought this site has lawyer advice!!! I guess not

Some issues are just not appropriate to be answered in an internet forum. As ecmst12 said - you need a sit-down-in-front-of-me attorney. You have little chance of "winning" if you choose to represent yourself regardless of the amount of information you glean from the internet.

That lawyers won't represent you unless you pay a large retainer means that your chances of getting anything out of a lawsuit are small even WITH a lawyer. Without one, you don't have a chance. Written disputes sent by certified mail and conversations with supervisors are more likely to get you what you want. You can also file a complaint with the FTC - info on how to do this is on the FTC web site.
