Fighting with Credit Card Company and Losing


i am located in texas and we have been fighting with a cc company for 3 months. the post office returned our mail with a change of address which is incorrect since july and they have turned our account over to a collection agency which is how we found out about it. we have made several agreements over the past 3 months by paying them they requested due amount with the promise they will reinstate our account which has never happened. with each payment sent, we wrote that by accepting payment, they agreed to reinstate our account. now they are telling us that they can accept payment without reinstating our account (which is in their fine print) and that the representatives who told us to pay the 3 monthly amounts were apparently mistaken and we are just out of the money and up a creek without a paddle. Anyone have any suggestions besides contacting a lawyer?

What exactly are you wanting to do??? I can assume that you want to 'reinstate' your account, but why??? There are literally 100's of credit card companies out there looking for credit-worthy people. Get a card from one of them and tell this other company to GTH!

Also, why, why, why did you make any repayment agreement (much less THREE of them) without any reinstatement agreement in writing. Without that, you have NO way to even prove that such an agreement existed.

Bottom line..... no creditor is REQUIRED to extend credit to you if they chose not to. And there is nothing you can do (even in court) to force them to reinstate your account.

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

You say you "are just out the money". This is your debt!!Have you considered actually paying off your debt in full before you go looking for more? Perhaps it is "credit-worthy" folks like you that helped to sink Providian.(No, Halket, I do not have stock in that bank.)

what do they mean you are just out the money? it is being applied to your debt right or are they just using it for tacked on fees?i think that is a strange statement for them to make.i mean it seems to me you have been trying to correct a postal error, not trying to get out of paying your bill.why else would you be trying to re-instate your account?i agree with halket find another credit card company although i am not sure any of them are better than the next.
also i was not aware that providian had sunk.any details on that one?

Though I certainly wouldn't mourn the loss of Providian (they are the bottom-feeders of the credit card world), I haven't heard anything about them 'sinking'.

In fact, according to my news check, their stock is doing very well after the appointment of the new CEO on 11/26/01.

Providian-from over $103 to under $3 in 2 years looks "sunk" to me.
Nevertheless, if the payments were applied to the poster's debt that is where they belong. Some clear correspondence with the cc will probably result in waiver of any late charges. I still say they should pay this off before applying for another card.

Sorry. I guess it is the interpretation of your post ("Perhaps it is "credit-worthy" folks like you that helped to sink Providian").

"to sink" (past tense, no longer afloat, gone, deep six) versus "the sinking" (present tense, taking on water, in the process of going under, still on the surface).
