FILING against CRA this FRIDAY.. some questions, hope you guys can help?What is the name of your state? California Here is my question.. I am filing in county/state court. There are california civil codes that grant so much $ per violation and also FCRA grants $ per violation. Is this cumulative? Can I claim $5k for CA and $1k for Federal and demand $6k? Or is it one or the other? How should it be worded? Also, how about the general format? Anyone have the general complaint format? I've seen various ones from where statement of facts is listed to cause of action, then the demands at the bottom.. anyhow, any comments? Thanks in advance.. |

| I *believe* you would have to list the damages you're claiming as separate lines - CA then Federal and list the statute/codes that apply to each. As for the format.. there are tons of resources all over the web, but there are a few people over at [url]www.creditinfocenter.com[/url] who have active cases or recently settled cases. Those guys could tell you how to format your paperwork.
