First Premier Nightmare!


What is the name of your state? Texas.

Hi, I checked my mail one afternoon and my husband had received another credit card in the mail. We had agreed that we'd not use any more until we paid off the ones we have so I took it and put it in our safe and never even told him about it. About a month later I got a bill for $198. I contacted the company and told them that the card had never been activated and certainly was never used. They argued with me over and over and about a week later the story changed and they now claim that they sent me a card too and that was the card that was used and get this, it was preactivated for our convience. Who mails out a preactivated credit card? No one I've ever heard of. They refuse to send any proof that this card was used and yet are calling my home up to 20 times a day, have called me every name in the book and now are calling my husbands work. They claim to be long lost friends when they call him at work. I've been cursed out and I've done nothing. I realize this is their job to call people but what steps should I take to put a stop to this and is there anything I can do? If I owed the money I'd pay it but I'm not paying something that must be a scam. I entered First Premier into the search bar and found all kinds of complaints like this from others.

I've seen versions of your story posted at other sites. People seem to have success by filing complaints with both the South Dakota state banking commission as well, as, the AG's office in South Dakota.
AS to the telephone. Call your local phone company and report them for harrassing communications.
Have you check your credit reports to see if they've made an entry?

I did notify the AG's office and had no luck there which isn't a shock since I'm in Texas. They have placed it on my credit report already and the company refuses to take it off unless I pay them but I'm just going to have to live with that becuase I'm not paying them anything. This company does have a bad reputation for doing things like this but it's a big company so it's hard to fight.

Go to [url]www.creditnet.com.[/url] It is a free site but, you mustregister. Go to the search function first and see others experience with this company and how they handled it. Once you've done some reading, post on the discussion board for more ideas.

Send them a letter (certified return reciept mail) requesting proof that this is your account. They are responsible for proving that this is yours. If you hadn't signed an agreement they don't have this. Mention that you are well aware of your rights and that you will be able to sue them for putting false information on your credit report. Make plans to take them to court. Hell...go on Judge Judy or something....they'd love that. From what I understand, small claims court is easy to do yourself.

Hi, I've sent them numerous letters and each one I copied and forwarded to the Attorney General's office and the Federal Trade Commission. In each of their letters they claim to have not received anything from me so I did send a certified letter and it was refused. Their policy stats that they will not accept certified letters from individuals. The letters they send me oddly enough have information in the from the letters I've sent so I'm sure the AG's office notices that too and they reword what I've said and just try to turn everything around. I've LOVE to go on Judge Judy. LOL. She's great. I'd hate to be wrong in her courtroom though.

If you did not sign a credit card contract THEY are wrong. Besides...a time back I had a landlord that filed to sue one of his tennants for monnies owed him in small claims. I'm not sure if it was Judge Judy, but one of them contacted him and asked if he would take his case to their court to be on tv. They also said that win or loose they would pay the money he says the tennants owed him. He didn't want to be on tv, but he did file and go to court without a lawyer.

Hi ibcurious,
I didn't sign anything with this company so I know I could take them to small claims court but hopefully through other channels they'll just quit. Although, I hate the thought that if I don't do something they're going to continue to do this to others.

You ought to be able to make some cash out of this deal. The FCRA calls for damages of up to a $1000 per violation. There is some case law on your side about the responsibility of both credit providers and credit reporters to be accurate. Go to [url]www.bankersonline.com[/url] and scroll to courtwatch. From there, you want the Fair Credit Reporting Act. The case is Nelson vs Chase Manhattan Mortgage. A very easy read for a legal opinion. Also, at [url]www.ftc.gov[/url] the "legal option there will take you to the Amicus brief the FTC filed on behalf of Nelson.

I just wanted to let you know that you should not put up with anyone cussing at you or calling you names. Just last night a collection agency called me. The person on the phone called me a deadbeat (which I am anything but.....). I said "Excuse Me? What did you call me?" This person kept telling me that she would NEVER call me anything. She asked me what I thought she said and I told her. She said that I misunderstood her. I then asked her if this call was being recorded. They always say that the call is being recorded. She told me "Yes, it is!" I then asked her if I could speak to her supervisor. She told me no, that I could call him tomorrow. She then told me to hold on. About a minute later a man came on the line and told me that this lady had just been terminated and is no longer employeed there effective immediately!!!! Do NOT put up with that at all. Gosh...I wonder if she might fall behind on her bills now????

I hope you called the company anyway because odds are she has some idiot sitting next to her lay that line on you thinking you'd forget all about what she had said.
