Foreclosure


I purchased a time-share in Fla. in 2000. In 2001 my 7yr old and I were displaced for 5 months due to a fire at our home in VA. I was not insured for this kind of disater and I can't afford to keep the time-share and my home. I asked the time-share people to foreclose on the time share but they said they would garnish my paycheck if they had to foreclose. Can they do that?:

Dear Ms. Moses:

If you are the head of your household 100% of your wages are exempt from garnishment in Florida. Any secondary source of income may be garnished at 25% of the take-home pay.

In any event, the creditor would have to sue you and obtain judgment prior to effecting any levies or garnishments against you.
