| Foreclosure - Deficiency Waived What is the name of your state? S.C.
(Yes, I know this is a duplicate post. However, I have not received any responses to my post in the Realestate forum, so I am posting it here in hopes of getting a possible answer).
Back in April of 1994, a home that I owned went into foreclosure. A judgement was recorded against me in reference to this foreclosure. I did not contest the foreclosure and the property had already been vacated. The home was sold at auction for less than the cost of the principal balance plus attorney fees. I was at the courthouse recently looking over the judgement file and noticed a document that was included which stated "Deficiency Waived". I was never contacted after the sale of the property regarding any deficiency amount owed. Therefore, I assume that the lender took what they got and let it go at that.
My question is: If in fact the deficiency amount was waived, does this mean that I do not owe the deficiency amount, and is the judgement that is listed in my name in the county record books essentially worthless? My reasoning is that if there is no amount due to be paid to resolve the judgement, then there should be no lien to prevent me from refinancing a current property that I own. Is my thinking correct? |
