Forgery By Husband!!!


What is the name of your state? Texas

I'm recently divorced and found out about a year ago that my own husband forged 15 of my checks without my knowledge. He had taken over all of our "financial" affairs. I'm trying to find out how long I have to press any charges against him and/or make a police report. These checks were written in 2004. Last one being in December of 2004. He claims he used the money to pay OUR bills but to me....forgery is forgery!!

A. You cannot "press charges" -- only the district attorney can file criminal charges. The most you can do is "file a civil lawsuit" -- although I am not sure what the complaint would say.

Q. and/or make a police report.

A. Don't know. Why don't you call the police and ask? Be prepared to explain why you waited so long to report this crime and what evidence you have that a crime was committed.

Q. These checks were written in 2004. Last one being in December of 2004.

A. So you have known for 18 months that the "forged" your name and are just now thinking you want to even the score? Right?

Q. He claims he used the money to pay OUR bills but to me....forgery is forgery!!

A. OK. I don't know if this applies in TX or to your specific situation -- in some civil situations the fact that you knew and did not do anything about it means that you effectively agreed or concurred with the action.
