Fraud on me...but CA are the biggest of all!


What is the name of your state? New York

About 2 yrs ago, someone stole my bonus checks my CC co sent me and made one of the checks out to Telecheck/Sprint wireless PCS at $348.00. The others amounted to $3652.00. After sending my CC co an affadavit with my signature, I was cleared and my acct. was credited and this was not put on my CR. They even sent me the 3 checks to show me how they were used. In case I needed it in the future. About 3 mos later I received a letter from a CA (Coldata collection agency) stating I owe Telecheck/Sprint wireless a debt. I called them and told them what happened to me and sent them the proof that I was a victim of fraud. About 5 mos later I received another letter from same CA, stating the same things. I sent them another letter with all the proof, only this time asked them to validate the debt and demanded proof that I was responsible. Well, 6 mos ago I received a letter from a different CA (Coldata must have sold the debt to the new CA) stating the same old garbage. I sent this CA a letter that wasn't very nice and sent them all the proof again. I just know they will send me another letter soon...and I am really getting tired of sending proof that I was a victim of fraud??? What should I do next...if a CA sends me yet another letter? How many times must I write and send them documents that I am NOT responsible for this debt? Can anyone give me some advise on what to do? Thank you in advance

Unfortunately every time the debt gets sold, you'll have to go through the same song and dance. As added insult, send copies of the letters from the previous collection agencies and your responses, as well. Eventually they MIGHT get the hint.
Actually, they're probably selling the debt because they know they can't collect on it, but they're selling it in portfolios to other agencies so it's not discovered that this debt is individually worthless.

Have you gone back to Sprint to figure out what Sprint account these payments were applied to? If you can figure out WHO stole your checks and applied them to THEIR bills, mayhaps YOU could press criminal charges and tack THEM with the collection account. Did they open the sprint account in your name with the checks, or did they use the checks to pay on an existing account?

Legal types, would this be worth investigating and pursuing criminal charges on? How would the process work?

The check was written out to Sprint...in amt of $348.00 with a phone number in the memo line. This person signed my name on the check and opened an acct in my name. I called that number and a man answered...I pretended I was calling for someone, hoping this man would slip up somehow and tell me his name. No luck. I'm assuming the acct was closed as soon as the CC co stopped payment. That is why they came after me. I have no way of finding out who did this to me...the CA told me they would investigate and tell this person's name...they never got back to me??? As far as the other 2 checks, it was definately the same person...he signed the checks exactly the same way...one was for a payment for a discover card and the other had Capitol one on it...I called both CC co.'s but they would not tell me who this person is? They said only the police could do that lol....I went to the police and they told me there's nothing they can do about it and gave me the run around. I would LOVE to find out who stole my checks and stole my identity and press charges. But no one will give me his name? Would you know how I can go about investigating on my own? Like perhaps through the internet? Or any other way to find out who this person is? I sent the CA the check and told them to go after THAT person for their money. I'm sure they have ways of finding out who it is. Thanx for your advise Kevinss....I appreciate it

Pardon my language.. but bull****. BULL-****. The police CAN do something about it - they just choose not to. You might call the state Attorney General's office and ask them how they would like for you to proceed. This guy CAN be tracked down, it's just a matter of getting the court order to do it. Try the AG. If that doesn't work, does anyone else have any suggestions?

Yes. I had my identity stolen a few years ago. You are in for more headaches. For me, they somehow got a hold of my bank account number without stealing anything from me. Then they got my driver's license number and made up counterfeit checks in my name and put my driver's license number on the checks. Only when I started getting NSF notices from my bank did I realize anything was wrong. They drained my account and started into my reserves. The following is what I did and it took months to get it so none of the business ever had cause to call me again. You are guilty in id theft, until proven innocent.

1. Contact your local police or sherriff dept. File a police report. Bring all your copies of the evidence, including your notarized fraud affidavits. The police should take it from there. I must admit, I too had a difficult time with the sherriff because of their laziness. If you have problems, take it up a step to your district attorney.

2. Then I contacted all the businesses where the checks were written and told them what happened.

3. Called Telechek and some of the others because I could not write checks anywhere until this was off my record. It was embarrassing. I felt like the criminal.

4. I never hired an attorney to help, but it sounds like you may need to with your repeat CA calls.

5. I had to change my driver's license number because it was used to commit a crime

6. I also red flagged 3 credit reporting bureaus

If you do a search, you will find many sites that deal with id theft and the steps you need to go through to get this taken care of. Good luck to you!

It was taken care of and the amt of money was credited to my acct immediately. It was never reported in my CR, just had a credit check done by a loan officer of the bank where we are taking a mortgage loan from. My credit came up as very good, and nothing was put on any of the bureau's. The problem I'm having is trying to find the colprit who stole my checks and get this CA off my back. They cannot put this on my report because they know it wasn't me. They are just trying to collect money that doesn't belong to them...so who's the one committing fraud here? lol...the CA of course. My identity was stolen for a brief moment...and only checks were forged. I now have passwords on each and every one of my CC's...and stopped all bonus checks from coming to my home.

**I doubt that you will ever find the culprit who stole your checks, I never did and I had the sheriff's dept working on it. The culprit even bought tires and I thought they cold trace it by the license plate, but I guess the car was stolen too.

So do the CAs stop temporarily once you send them the info? I would think this would be against the law for them to continue to hassle you.**

I have written 3 letters with 3 sets of proof to the CA...unfortunately, the last letter was to a different CA, as they sell and resell these debts. I got so pissed, I threw out the letter from the last agency...but I am very sure they will send me another letter in the near future. Heaven help them if they do...I plan on holding them liable. Thanx for responding

**What I usually do in my correspondence is mention something about my attorney, this seems to always get their attention, and miraculously everything gets taken care of. In your next letter you send rrr, mention something about your attorney and see what happens**

Thanx for the advise...will do. I'm not only sending the letter rrr, but also 1st class mail with a "certificate of mailing" receipt. This way I can prove I sent it to them. They have messed with the wrong person lol.
