freezing of accounts


What is the name of your state? NC
Is it legal to have a checking accounts assets frozen without receiving any notification? My husband has an old debt but I am the owner of the chekcing account. Without notice my assets were frozen last week and the attorney said he could "take" all my money. Is this right??????

A few more details please? Did your husband lose a lawsuit or, have a default judgment entered against him and, are both names on the account?

My husband was served with papers concerning exemptions from the sheriff's dept in 2001 and had been making agreed payments each month to the attorneys. He fell behind when his job was cut back. The account has me listed as the "owner" of the account but he is allowed to sign checks.

If his name or ss# is on that account, it's fair game.
Open a new account with you flying solo.

And..

In order to get YOUR portion of the funds from the account back, you would have to prove that it was yours and not his.
