garnishing waitress wages???What is the name of your state? arizona help please! i got a few questions i can't find answers for. first question: can a joint bank account be garnished if the debt is in only one of the account holders names? we are not married or related in any way. second question: my wages consist of mostly tips. my paycheck accounts for less than 10% of my income. my income is rather inconsistant, would they still take a set amount? third question: how many creditors can garnish at one time? fourth question: can they put a lein on a home or car that is in two names? thank you-thank you-thank you mushroom ![]() |

| None of the items you describe (garnishment, siezures, etc.) can be done on just 'debts'. The creditor would have to have a judgment against you first. If you have mis-stated the situation and a judgment has been rendered against you, the following apply: Q1) "can a joint bank account be garnished if the debt is in only one of the account holders names?" A1) Yes. However, the non-debtor can file a challenge to the garnishment seizure and, if he/she can show that a portion of the seized funds were in fact the non-debtors, the court could rule that percentage of the seizure returned. Q2) "my wages consist of mostly tips. my paycheck accounts for less than 10% of my income. my income is rather inconsistant, would they still take a set amount?" A2) Your employer would determine the amount to be held, including an allowance for 'normal' tips. Q3) "how many creditors can garnish at one time?" A3) Only one judgment creditor can have a garnishment in place at the same time. Q4) "can they put a lein on a home or car that is in two names?" A4) Yes. Again, the debtor would have to show the percentage of ownership. "thank you-thank you-thank you" You're welcome-you're welcome-you're welcome
__________________ There are at least 17 lawsuits (!!) pending in various courts, including the US Supreme Court, asking if Obama is a natural born citizen (as req'd by Art II, Sec 1 of the US Constitution). Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport! |
