Garnishment of Bank account


What is the name of your state? Maryland
My fiance has a judgement against him for an unpaid credit card. Two days ago our joint checking account had all of our money withdrawn, we were left with a one cent balance. Can they garnish this account? Today my fiances pay check was directly deposited into the account, we were told by the bank that we can not get any of this money, can they keep this money from us? We need money for food and rent.

They got the judgment, they can levy the account if his name is on it. If you want to get back that portion of the money that is yours, you're going to have to prove to the bank, and the court, what part of that money was yours.

Your fiance had better contact the judgment creditor and make arrangements to pay, otherwise he's going to keep losing paychecks.

Can my fiance go to his employer and have they stop the direct deposit of his checks from noiw on???

Unless there's some company requirement, he certainly should be able to, and I'd do so, ASAP.

My response:

. . . and then the creditor serves your employer with a Writ of Garnishment, and money is taken directly from your paycheck each week - - pissing off your employer due to the accounting nightmare you have caused!

I would rather them garnish a percentage of the pay check each week, in stead of taking the entire check. We do need money to live on!!!
