garnishment for OLD debti live in KY. i received a wage garnishment notice for a debt that is 12 yrs old. (there is a judgement date of 3-20-1989) this is for a car loan that my ex-husband & i had. we both signed the loan papers although i was not employed at the time. in Nov. 1988 we seperated and he kept the car(in another state, Virgina ) and obviously never paid for it. our divorce was final in 10/1990. now the creditor's want to garnish my wages to pay off this debt. (They can't get the money out of my ex, he owes in excess of $60,000 in child support) The amount they want to garnish is $6,500. or they said they would settle for $2,500 if i could pay it within 3 days. Is there a statue of limitaion on debts? It seems strange that they waited 12 yrs to notify me of this situation. I have lived at the same address for this entire time. is there any way that i can fight this? i cannot afford to have my wages garnished, i barely make it on my earnings without child support. please help!!!!!! nmalcom |

| [url]http://www.cardreport.com/laws/judgement-sol.html[/url] The KY SOL on Judgements is 15 years. When you were divorced, was there any provision in the papers about the car? Was it awarded to him along with the payment? If so, you can take him to court for the money. You probably won't see it. What are you doing about the $60,000. in arrearages? Have you filed with your CSEA to have HIS wages garnished or anything? If not, you need to get to the CSEA as soon as you can. I'm not sure that there is anything else that you can do but pay the bill, then file against your ex. You were still married at the time of the judgement and if you were listed on the judgement, then it is your responsibility to pay. (I don't agree with it, sonce you didn't have the car and it was your husbands responsibility. He is obviously a loser if he isn't paying bills OR CS.) Sorry. I wish I could give you better news. The only thing I can think of is for you to give them all the information you can on your ex. They can try to garnish his wages as well. |
