| my husband and i filed bankruptcy in 1998 (i don t remember, but i think it was chapter 7). the only creditor who challenged it was sears. the sears credit card was my husband s ex wifes card. my husband had no jurisdiction over the card and was just a signer, so the court ruled in favor of sears collecting the debt. since my husbands ex wife didn t incurr the debt herself she will be coming after us to pay sears. sears will go to her to establish a montly payment amount for paying back the amount due. we are responsible for paying her what she pays out each month. if she sets a really high payment per month that we can not pay, am i correct in understanding the only thing that could be done is that my husband s paycheck will be garnished 25 percent? they won t take money away from what we need to pay rent, is that right? as crazy as it sounds we are considering buying a house - the mortgage will not be more than what we are currently paying in rent. our lawyer told us that it may take a year or more for the final judgment to come through and we don't want to wait another 2 or 3 years to buy a house. so again, am i correct in understanding that all that could be done (if we cant pay the payment amount set) is that my husband s paycheck will be garnished 25 percent and a lien be put on the house??
