I am trying to help my father-in-law who lives in West Virginia and has cosigned a couple of mortgages for his son, and son's friend for investment properties they were renting out in that state. The homes are now being foreclosed on for back taxes owed. The bank has explained that they will be garnishing his wages to collect this debt after it becomes a judgement if there is a deficiency balance. I understand that under wage garnishment, the employer of a judgment debtor is directed to withhold a portion of the judgment debtor's wages earned (typically up to 25% for a money judgment) and then make this payment directly to the judgment creditor.
My question is: What does wage garnishment include as wages? In particular, does it include pension as wages? Social Security as wages? Is there a list of items that would be considered wages (and assets)? I understand in some states these may vary.
