i am from michigan, i have an outstanding bill at a daycare received letter to contact them and set up payments i did this they received a payment and cashed it this month now the collection agency says that they want it directly out of my checking account i told them no so he said he is going to proceed with legal action. can he do this since there was an agreement with the day care and they cashed a payment i sent them after the agreement was made. the day care is in pennsylvania. help me please.

My response:

Unless your agreement with the daycare center was in writing, then you'd have a difficult, if not impossible, task to prove that any agreement existed at all.

Even if you made a payment under the so-called "agreement" that, in and of itself, does not mean that there was an agreement - - or that the daycare center will admit that one existed.

So, the collection agency can refer this matter back to the daycare center with a recommendation to sue you for the entire balance, including interest, costs of collection, and attorney's fees, provided that your written agreement for daycare services had such terms and conditions within that contract.
