Help with Malicious Prosecution


After getting a judgment against the judgment debtor, she called police and made a false police report resulting in a trespassing ticket for me. (Her family "witnessed" the lie.)
I got an attorney to fight this charge. Accusers decided not come to court to testify against me (didn't want to lie under oath) so the night before my trial the charges were dropped. I paid $500 for my attorney and would like tp sue the debtor (accuser) for malicious prosecution to recoup my $500. Can I do this in Small Claims?

Sure, you could sue.

However, here's a thought... If you already know that this person is a psycho, and that they are willing to go to extremes to get you into trouble, and that they have friends who support their ways, why push it?

$500 isn't worth your time, safety and sanity.

Choose your battles carefully.....

A further thought....

I remember a few years back, when I first realized that I had the power and ability to cause havoc against others using the legal system... I sued people for some pretty stupid stuff.

Was I legally correct? Sure. Was I doing the right thing by suing them? In most cases, no. Did I end up looking like a complete ass for using the court system to solve trivial problems? Definately.

Whenever we are wronged by another person, our instinct is to "sue them for all they've got!!!" Doing so is not only foolish, is hurtful and just plain wrong.

If someone causes you a trivial amount of harm, turn the other cheek and let it go.
