High Debt


What is the name of your state? GA. I posted previously and got a reply but it did not really answer any of the questions that I asked. My husband owes about $48,000 in credit card debt that unfortunately was due to a failure of a business. He had a joint bank a/c with his mother who drained the account, closed it, and fled the country. I own the house, my husband's name was never on it at any time due to his high credit card debt. He wants a clean start...he talked to a BK lawyer, who really wasn't much help...said his income would be hard to prove since he is self employed.

He owns nothing....all the vehicles are in my name too. If they took him to court and got a judgement against him, what could they do to him?? We were able to make all payments until his mother freaked out on us and fled with the $$$. Now we are having a hard time paying. He has dissolved his business and is having a hard time finding a job that will pay for his debts...He is 52 and no one will hire him...they tell him (off the record) that he is too old...If he got a job at McDonald's that wouldn't even pay the finance charges!!! His creditors don't want to work with him at all....right now I just feel like telling them TOO BAD.. Then you won't get paid at all! I am pregnant and on bedrest due to complications so I am working from my bed and the insurance we found out is not going to be paying for the baby or the hospital. Now I will have medical bills to pay for which I think would be more important than credit card bills.

I am assuming that they cannot harrass me about paying since I am not on any of his cards. My credit is impeccable and I am going to keep it that way. One doesn't know the future, and if one did, one would be able to avoid any mistakes, bad investments, etc.

I'd suggest your husband get a second opinion. Worse case and he needs to document his income then, have get a job at McDonalds.
If all of the assets are in your name, there is little they can get if the sue. Ga. is not a community property state but, with your medical condition and a baby on the way, the stress of collection calls may be intolerable. Most lawyers give free initial consultations. Get a couple of more opinions.
